Regulations on and Enforceability of Physician Non-Competes
Non-competes have become more of a hot topic than ever before, following the FTC’s recent attempt to ban such clauses nationwide. This is especially true for physicians and others in the healthcare sector, where employers frequently leverage non-compete clauses against employees.
While a nationwide ban never went into effect, some states have restricted or banned non-competes on their own. When faced with an employment contract that includes a non-compete, a physician must consider many factors before signing.
Are there laws restricting non-competes in the physician’s state, county, or city? Is the geographic scope of the non-compete reasonable? What about the timeframe for which it will be active?
